1. General provisions
These Terms govern the electronic provision of ASK Serwis Manager by A.S.K. P.S.U. Sp. z o.o., the “Operator”.
ASK Serwis Manager is a multi-tenant SaaS platform supporting service operations including customers, equipment, jobs, quotations, parts, calendar, communications and technician work.
The service is primarily intended for businesses and organizations. Mandatory rights that apply to a particular user are not limited by these Terms.
2. Account and organization
Creating an organization requires accurate information, an active email address and a secure password. The person creating an organization confirms that they are authorized to act for it.
The organization is responsible for user permissions, safeguarding credentials and actions performed by its accounts.
3. Trial, plans and payments
The Operator may offer a trial period and plans with different limits and features. Current plan terms, periods and prices are displayed before an order is placed.
For bank-transfer payments, activation may follow receipt or administrative confirmation of payment. An individual plan is a private offer assigned to a specific organization and does not automatically replace its active plan.
4. Acceptable use
Users must use the service lawfully, for its intended purpose and within their permissions.
- attempts to access another organization’s data or Operator infrastructure are prohibited;
- unlawful content, malicious code or data processed without a lawful basis must not be uploaded;
- the organization is responsible for the accuracy of its data and the legality of communications sent to its customers.
5. Organization email and SMS
An organization may configure its own SMTP server and SMS provider. Organization credentials are technically separated from the Operator’s system channels.
The organization is responsible for the lawful basis, content, sender data and provider terms applicable to its communications.
6. Availability and maintenance
The Operator maintains and develops the service with due care. Planned maintenance, infrastructure failures or third-party outages may occur.
Updates may change the interface and operation of features provided that they do not unlawfully remove a paid scope of service.
7. Data and backups
Organization data is logically separated from other customers. Access control, audit and backup mechanisms are applied according to the current service version.
Organizations should keep their own copies of data whose loss could cause material harm, especially records required by separate laws.
8. Personal data and processing
For customer, employee, technician and other personal data entered by an organization, that organization generally remains the controller and the Operator acts as processor on documented instructions.
The Data Processing Agreement forms an integral supplement to these Terms.
9. Liability
Each party is responsible for its own acts and omissions under applicable law. The Operator is not responsible for content entered by the organization or business decisions made solely on the basis of system data.
Nothing excludes liability where exclusion is prohibited by mandatory law.
10. Ending use
An organization may stop using the service under the terms of its active subscription. After termination, data may be retained for a technical and legal period described in the Privacy Policy or DPA and then deleted or anonymized.
11. Changes and contact
The Operator may update these Terms for material reasons such as legal, security, service-delivery or functional changes. Material changes will be communicated with appropriate notice where required.
